Terms and Conditions – Nairu Creations LLC

By accessing or using our website (www.nairu.store), purchasing products, or participating in events organized by Nairu Creations LLC ("Nairu," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully.

1. General Terms

  • Modifications: We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of our services constitutes acceptance of any changes.

  • Governing Law: These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law principles.

2. Product Information and Third-Party Vendors

  • Product Descriptions: We strive to ensure that product descriptions, images, and prices are accurate. However, we do not warrant that such information is complete, reliable, current, or error-free.

  • Third-Party Products: Some products sold by Nairu are sourced from third-party vendors. While we select our vendors carefully and rely on their representations regarding product authenticity and quality, we may not have full visibility into their manufacturing processes or terms. By purchasing such products, you acknowledge and accept this.

3. Order Processing and Shipping

  • Processing Time: Orders are typically processed within 2–3 business days. During peak periods (e.g., holidays, sales), processing times may be extended. We will notify you of any significant delays.

  • Shipping Partners: We utilize USPS, UPS, or FedEx for shipping, based on your selected shipping method and cost.

  • Multiple Orders: If you place multiple orders, please notify us via email to combine shipments when possible.

  • Order Cancellation: Orders may be canceled within 4 hours of placement. Once shipped, all sales are final. We reserve the right to cancel any unshipped order at our discretion. Canceled orders are subject to a 5% restocking fee.

  • Contact Information: Accurate contact details are essential. Failure to provide correct information may result in order delays or cancellations.

4. Returns and Refunds

  • Final Sale Policy: Due to the nature of our products, we do not accept returns or issue refunds once an order is shipped. Exceptions may be made at our discretion.

  • Damaged Items: If items arrive damaged, please provide photographic evidence and contact us within 48 hours of receipt. We will assist in filing a claim with the shipping company.

  • Allergy Disclaimer: Our products may contain or come into contact with allergens such as soy, coconut, beeswax, and various essential oils. Customers with sensitivities should exercise caution and consult product descriptions before purchase.

5. Event Participation

    • Registration and Consent:
      By registering for or participating in any Nairu Creations LLC (“Nairu”) event, you (and your parent/guardian if under 18) acknowledge and agree to:

      • Receive communications, including marketing messages, from Nairu and its partners via email, phone, text, or other channels provided at registration. Standard message and data rates may apply.

      • Comply with all event rules, safety protocols, and instructions provided by Nairu and event staff.

    • Media Release and Usage Rights:
      By participating, you irrevocably grant Nairu and its partners, affiliates, licensees, and successors:

      • The unrestricted, royalty-free, worldwide right to record, photograph, film, livestream, or otherwise capture your likeness, voice, performance, and any materials you provide or present.

      • The right to edit, adapt, publish, distribute, display, reproduce, broadcast, and use such recordings or materials in any media format now known or developed in the future (including but not limited to digital, print, audio, video, social media, and promotional materials) for commercial, marketing, entertainment, and archival purposes, in perpetuity, without further notice or compensation.

      • The right to sublicense and assign these rights to third parties for these purposes.

      • No right of approval or review of the use of such recordings or materials is granted.

    • Behavior and Removal:
      Nairu reserves the absolute right, at its sole discretion and without refund, to refuse entry to, remove, or ban from participation any individual for any reason, including but not limited to:

      • Disruptive behavior, harassment, vulgarity, intoxication, safety concerns, or non-compliance with event rules or staff instructions.

      • Any action deemed harmful or detrimental to the event’s integrity, safety, or enjoyment of others.

      • Participation may be suspended or terminated immediately, and the participant may be barred from future events or activities.

    • Prizes and Awards:
      Prizes are awarded solely at Nairu’s discretion and as announced at the event. Prizes are provided “as is,” without warranties, guarantees, or representations. They are non-transferable, non-exchangeable, and may not be substituted or redeemed for cash.
      Nairu reserves the right to modify, cancel, or withhold prizes in cases of participant misconduct or other violations of these Terms.

    • Assumption of Risk:
      By participating, you acknowledge and accept all risks associated with the event, including but not limited to personal injury, property damage, and exposure to contagious diseases. You voluntarily waive and release Nairu, its partners, sponsors, and affiliates from any and all claims, liabilities, or damages, except where prohibited by law.

6. Limitation of Liability

To the fullest extent permitted by applicable law:

  • No Warranties:
    Nairu Creations LLC (“Nairu”) disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement, with respect to all products, services, events, and content.

  • No Liability for Damages:
    Nairu, its affiliates, partners, suppliers, licensors, or third-party contractors shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with:

    • The use, misuse, or inability to use our products, services, or website,

    • Participation in any Nairu event or activity,

    • Errors, inaccuracies, or omissions in content or product descriptions,

    • Loss of data, revenue, profits, goodwill, or other intangible losses,

    • Any unauthorized access or use of our servers and/or personal information stored therein.

  • Assumption of Risk:
    By purchasing products or participating in events, you acknowledge and voluntarily assume all risks associated with the use or participation, including but not limited to personal injury, property damage, or loss.

  • Indemnification:
    You agree to indemnify and hold harmless Nairu, its officers, employees, partners, contractors, and affiliates from any claims, damages, liabilities, or expenses (including reasonable attorneys’ fees) arising from your use of our products, services, website, or event participation.

  • Jurisdictional Limits:
    Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

7. Consumer Rights

Nothing in these Terms is intended to waive any rights you may have under applicable consumer protection laws, including the New Jersey Truth-in-Consumer Contract, Warranty and Notice Act (TCCWNA).
